Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the HoopsAPI service ("Service") operated by Newstats, a company registered in Ireland ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

2. Service Description

HoopsAPI provides a REST API for accessing basketball odds data aggregated from multiple bookmakers. The Service includes real-time odds, historical data, and cross-provider comparison features, subject to your subscription tier.

3. Accounts and API Keys

You must create an account to access the Service. You are responsible for maintaining the confidentiality of your API key and for all activities that occur under your account. Each account is issued one API key. You must not share your API key with third parties.

4. Subscription Plans and Billing

The Service is offered under fixed subscription plans (Free, Starter, Pro, Data) with daily request limits. Paid plans are billed monthly or annually in EUR via Stripe. There are no usage-based charges or overages — when you reach your daily limit, further requests receive a 429 response until the next day (midnight UTC).

You may upgrade, downgrade, or cancel your subscription at any time through the billing portal. Cancellations take effect at the end of the current billing period.

5. Acceptable Use

You agree not to:

• Resell, redistribute, or sublicense raw odds data obtained through the Service
• Use the Service to construct or operate a competing odds aggregation service
• Attempt to circumvent rate limits, authentication, or other security measures
• Use the Service in any jurisdiction where the consumption of sports betting data is prohibited by law
• Interfere with or disrupt the Service or its infrastructure

6. Data Accuracy

Odds data is provided on an "as is" basis. While we strive for accuracy, we make no warranties or guarantees regarding the accuracy, completeness, or timeliness of the data. You acknowledge that odds data changes rapidly and that discrepancies between our data and live bookmaker data may occur. You are solely responsible for any decisions made based on the data provided.

7. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience downtime. We are not liable for any losses arising from Service unavailability.

8. Intellectual Property

The Service, its API design, documentation, and website content are the intellectual property of Newstats. Your subscription grants you a limited, non-exclusive, non-transferable license to use the API for your own purposes, subject to these Terms.

9. Termination

We may suspend or terminate your account at any time if you violate these Terms, including but not limited to data redistribution, abuse of the Service, or non-payment. Upon termination, your API key will be revoked and access to the Service will cease immediately.

10. Limitation of Liability

To the maximum extent permitted by law, Newstats shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Service.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via the email address associated with your account. Continued use of the Service after such changes constitutes acceptance of the updated Terms.
